Who we are
Side Quest Booking is operated by MitchBrownPhotoFreediving LLC, in Hawaii, United States ("we", "us"). These terms are between us and the business using Side Quest Booking ("the business"). Contact: [email protected].
If you are booking an activity
Your booking is a contract between you and the business you booked with. Their own booking, cancellation and refund terms, shown before you pay, apply to it. We provide the booking page and take payment on the business's behalf; we do not run the activity and are not responsible for how it is run. Questions about your booking go to the business first. How we handle your information is in our privacy policy.
- Answer the business's questions truthfully and read a waiver before you sign it. A parent or guardian signs for a child.
- Signing a waiver does not by itself clear you to take part. If the business needs a doctor's sign-off, follow their instructions.
- A place on a waitlist is not a booking. If you agree to be booked automatically with a saved card, you are told exactly what will be charged first.
- Tips are optional and go to the business. The tip page shows their refund policy for tips.
What we provide
Online software for taking and managing bookings: a catalogue, schedule, booking pages, questionnaires, waivers with electronic signature, rosters, emails, and taking payment. We work to keep it running and secure, but we do not promise it will always be available or free of mistakes.
Your responsibilities as a business
- What you list is accurate: prices, dates, places, age limits and what is included.
- You publish your own booking, cancellation and refund terms, and you give refunds under them.
- You choose the questions you ask, including health questions, and you are responsible for collecting and using the answers lawfully.
- You hold the licences, insurance and certifications your activity needs. We do not check them.
- You decide who on your team can sign in and what they can see, and you keep sign-ins secure.
- You do not use Side Quest Booking for anything unlawful, or to send messages people have not agreed to receive.
Safety decisions are yours
Side Quest Booking can flag a health answer or a missing waiver, but it is not a medical service and does not decide whether anyone is fit to take part. That judgement stays with you and your staff.
Payments
- Card and wallet payments are processed by Stripe, and PayPal and Venmo payments by PayPal, under their own terms, which you accept with them directly.
- You are the seller for each booking. Card numbers never reach us.
- Our fees are shown to you before they apply.
- If you connect your own PayPal account, those payments go straight to it, and PayPal's terms between you and PayPal apply to them.
Disputes and chargebacks
A customer can ask their card issuer to reverse a payment. The issuer decides, not us. If a dispute is lost, or you choose not to answer it, the disputed amount is yours to cover, along with the dispute fees charged by the payment processor, at cost with no markup. We may take these from your payouts, and if payouts do not cover them within 30 days, invoice you. Each one is shown to you as its own line. We tell you about a dispute promptly and help you answer it from the booking, the terms shown before payment and any signed waiver.
Your information and your customers' information
Your customers' information belongs to you. We hold it for you, use it only to provide Side Quest Booking, and handle it as our privacy policy describes. Our support staff look inside your account only with your owner's approval. You can ask for a copy of your data at any time.
Ending
You can stop using Side Quest Booking at any time. We may suspend or end an account that breaks these terms, puts customers at risk or is not paid for, and will give notice where we reasonably can. When an account ends, you can ask for a copy of your data first. Signed waivers and payment records are kept for the periods in the privacy policy.
Limits on liability
To the extent the law allows, we are not liable for indirect losses, such as lost profits or bookings, and our total liability to a business in any 12 months is limited to the fees that business paid us in those 12 months. Nothing here limits liability that cannot be limited by law.
Changes
If we change these terms in a way that matters, we will update the date at the top and tell businesses before the change takes effect. Continuing to use Side Quest Booking after that means you accept the new terms.
Law
These terms are governed by the laws of the State of Hawaii, United States.
